Recently some of the residents and property owners in the Deer Mountain Residential Subdivision may have received a letter from a law firm located in Mitchell initiated by three non-residents of the Deer Mountain Residential Subdivision but who are property owners. These property owners seek to amend the current “Use” covenant as recorded in the Lawrence County Register of Deeds office. The prosed amendment is crafted not to permit commercial business on properties within the subdivision but includes a statement that short-term vacation rentals are not to be considered a prohibited commercial business.
Short-term vacation rentals have become a hotly discussed concern throughout communities in the Black Hills and beyond. The cities of Lead, Deadwood, Hill City, and Custer have initiated rules, regulations, fees, and in some cases, the banning of any future short-term vacation rentals in their cities. Though these short-term vacation rentals may have a significant impact on our local economy, they can also have a detrimental effect on the quality of life in neighborhoods and communities. Deer Mountain Sanitary District and Road District have limited purposes. The Districts, therefore, do not take a position on this proposal and instead encourage all parties to investigate the amendment's impact. 8.23.22 UPDATE: Those desiring to vote early, prior to 9/1, please call 605-641-3365 and schedule an appointment to come by the polling location to vote. Notice is hereby given that there will be a special election for Resolution 2022-13 to submit to the voters within the sanitary district the question of whether to increase the Board of Trustees from three to five members. A yes vote will be to increase the Board of Trustees to five. This resolution will not become effective unless approved by majority vote.
